General Terms and Conditions (AGB)
Watches in Germany
Version: 12 October 2026
1. Scope and Seller
These General Terms and Conditions apply to purchases made by consumers through www.watchesingermany.com.
The seller is:
[Full Legal Business or Proprietor Name]
Trading as: Watches in Germany
Address: [Full Business Address]
Email: [Contact Email]
Telephone: [Contact Number]
A consumer is a natural person entering into a transaction predominantly for purposes outside their trade, business, or profession.
Individually agreed terms take precedence over these General Terms and Conditions.
2. Products and Descriptions
The relevant product page describes the watch’s specifications, condition, price, and included accessories.
For pre-owned watches, the description identifies relevant signs of wear and the availability of boxes, papers, or other accessories.
Product photographs form part of the description where they show the specific watch offered. Minor differences caused by screen settings do not change the agreed product characteristics.
Any departure from the objectively required condition of a product must be specifically disclosed and expressly and separately agreed where required by law. A general description such as “pre-owned” does not remove statutory rights relating to defects.
3. Ordering and Contract Formation
Product listings constitute an invitation to submit an order.
Before submitting an order, you can review and correct your details using the functions provided during checkout.
By submitting an order through the final button clearly indicating an obligation to pay, you make a binding offer to purchase the selected products.
We acknowledge receipt of your order electronically. An acknowledgement alone does not constitute acceptance unless it expressly states that we accept your order.
The contract is concluded when you receive our express acceptance by email. Bank transfer instructions are provided with that acceptance.
If we cannot accept your order, we will inform you and refund any payment already received for it.
Available contract languages: [English / German — Confirm Actual Languages]
You can save or print these terms before ordering. We provide the agreed contract terms and required consumer information in a durable format, such as email.
Access to stored order details: [Explain Whether Customers Can Retrieve Their Orders Later and How]
4. Prices and Shipping Charges
The price displayed when you place your order applies to that order.
Consumer prices include any VAT payable under the applicable tax treatment. Any applicable special VAT treatment is identified where required.
Shipping charges and any other charges payable to us are disclosed before you submit your order.
Currency: [Confirm Currency]
Delivery restrictions and available destinations are disclosed at the beginning of the ordering process.
5. Payment by Bank Transfer
Payment is made by advance bank transfer to the account specified in our acceptance email.
Payment deadline: [Insert Agreed Deadline]
Please include your order reference so that we can allocate the payment correctly.
Dispatch takes place after receipt of the full payment, within the delivery period agreed for your order.
If payment is not received when due, we may exercise the remedies available under applicable law, including withdrawal from the contract after an appropriate additional payment period where required.
6. Delivery
We deliver to the address supplied when ordering, within the delivery period stated before the contract is concluded.
Please check your delivery details carefully and contact us promptly if a correction is needed.
If delivery is delayed, we will inform you. Your statutory rights concerning delayed or failed delivery remain unaffected.
For consumer purchases, the risk of accidental loss or damage generally remains with us until you or a person nominated by you receives the goods. The statutory exception applies where you independently commission a carrier that we have not previously named.
Please report apparent transport damage promptly where possible. Failure to do so does not remove your statutory rights.
7. Retention of Title
The goods remain our property until the purchase price has been paid in full.
8. Consumer Right of Withdrawal
Consumers generally have a statutory right to withdraw from a distance purchase within 14 days without giving a reason.
For a single delivery, the period begins when you or a third party nominated by you, other than the carrier, receives the goods. For an order delivered separately, the applicable statutory rules determine when the period begins.
To withdraw, inform us through a clear statement, such as an email or letter:
[Legal Seller Name]
[Business Address]
[Contact Email]
You may use the model withdrawal form supplied with our separate Withdrawal Instructions, but its use is not mandatory.
Online withdrawal function: [Insert Link to the Implemented Withdrawal Function]
Sending your withdrawal statement before the deadline is sufficient to meet the withdrawal period.
The complete instructions, model form, and any legally applicable exceptions are set out in our separate Withdrawal Instructions (Widerrufsbelehrung).
9. Returns and Refunds Following Withdrawal
After withdrawal, return the goods without undue delay and no later than 14 days after notifying us, unless we have offered to collect them. Sending the goods before that deadline is sufficient.
Return address: [Full Return Address]
Direct return shipping costs: [Specify Whether the Seller or Customer Pays, Consistently with the Withdrawal Instructions and Pre-contract Information]
We refund payments received, including the cost of our least expensive standard delivery option, without undue delay and within 14 days of receiving your withdrawal statement.
Additional delivery costs resulting from your choice of a more expensive delivery option are not refundable under the statutory withdrawal rules.
We may withhold the refund until we receive the goods or evidence that you have sent them back, whichever occurs first, unless we have offered to collect them.
Refunds use the original payment method unless another method is expressly agreed without additional cost to you.
You are responsible for diminished value only where it results from handling beyond what is necessary to establish the goods’ nature, characteristics, and functioning, and the applicable statutory information requirements have been met.
Please return supplied accessories, documents, and packaging where available. Original packaging is not a condition for exercising your statutory withdrawal right.
10. Statutory Rights for Defective Goods
Your statutory rights concerning defective goods apply.
These may include repair or replacement and, where the legal conditions are met, a price reduction, termination of the purchase contract, or damages.
We do not shorten statutory limitation periods through these terms, including for pre-owned watches.
Wear, misuse, or damage occurring after delivery does not itself establish a defect existing at delivery. This does not affect your rights where the product was defective or did not meet the agreed requirements.
Please contact us using the details in Section 1 if you believe a product is defective.
11. Additional Guarantees
Any manufacturer’s guarantee or additional seller guarantee applies only where expressly offered and according to its stated conditions.
An additional guarantee does not replace or restrict your statutory rights against us.
12. Liability
Our liability is governed by applicable statutory law. These terms do not exclude or limit liability for personal injury, intentional misconduct, gross negligence, or any other liability that cannot lawfully be excluded or restricted.
13. Personal Data
Information about the processing of personal data is provided in our Privacy Policy.
The Privacy Policy is an information notice and does not constitute consent to processing that requires separate consent.
14. Consumer Dispute Resolution
[Insert the statement matching your actual participation status, obtained from your lawyer-reviewed legal text generator.]
15. Applicable Law
German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.
Where you are a consumer habitually resident in another country, this choice of law does not deprive you of protection provided by mandatory provisions that would otherwise apply.
These terms do not restrict your statutory rights concerning the competent courts.
16. Applicable Version
The version of these terms agreed when your contract is concluded applies to that contract. Later changes do not automatically alter existing contracts.
